Your Credit Report What Are Your Rights in Manitoba Canada?

By: Robert C.C. Lamb

A bank credit that you request for was turned down. The bank alleged that your personal credit record disclosed that you were an unfavorable risk.

The first time you formally request for credit or a loan a typical credit folder is started. This record consists of your home address and basic facts on your job, salary and paying habits.

Banks, credit unions, stores and potential employers sometimes hire credit reporting agencies to list personal information on certain individuals’ monetary and communal activities.

The data compiled aid these organizations in determining whether or not to give a person credit, tenancy, insurance or employment.

Protective measures are implied to ensure personal file information is exact and correct and it is the right of all Manitoban residents and citizens to both know, comprehend and have an understanding of the significance as well as ramifications thereof of the chapter and verse that resides in their personal file.

What’s in your Personal File

A firm, establishment, credit union, bank or personal reporting agency may have a personal file on you.
You may provide facts about yourself. You have the privilege to examine all details of information in your file once every six months or if you have been denied a benefit covered by The Personal Investigations Act.

The resulting parameters should be followed when looking into your file at a personal reporting agency:

•Inquire if the agency has a file on you.

•If there is a record request a reproduction of it. (You will have to confirm who you are and may have to pay a small charge). It is an official crime against moral, social or other accepted standards under The personal Investigations Act to disclose the subject matter of a personal file to anyone who is not permitted to acquire knowledge about it. For more information on the type of information that can be exposed under the Personal Investigations Act, contact the Consumers’ Bureau.

•If you find out about some information in your personal file that is not in the normal satisfactory state, there are steps to follow under The Personal Investigations Act for initiating a complaint.

•If the information cannot be substantiated. The Personal Investigations Act states that the information must be stripped off from your file. However, if the information can be verified and meets the entire requisite within The Personal Investigations Act, the protest must be documented in the personal profile.

The action taken must be made known to you and to anyone who has been given the report within the previous 60 days.

•If you are not satisfied with the way the action done ,you may appeal the matter to the Director of the Consumers’ Bureau.

The Personal Investigations Act

In Manitoba you have certain entitlement and freedom regarding your file. These rights include:

•The justified entitlement to be informed if a personal investigation is being initiated on you.

•The right to come across information on the data in your file.

•The right to protest any information in the file that is incorrect or not allowed to be included, as provided for in The Personal Investigations Act.

•The Personal Investigations Act ascertains that only genuine and probing information can be contained within a personal file.

In most cases when you request and apply for credit, occupancy, coverage or employment, your permission must be obtained beforehand for a personal investigation to be done.
